These terms apply to everyone who uses this website. By using it, you agree to them. If you do not agree, please do not use the website.
1. Who we are
The website is run by The Jai Zharotia Foundation on behalf of the holders of the estate of the artist Jai Zharotia (“the Foundation”, “we”, “us”), A-11 Kaladham, Knowledge Park 2, Greater Noida 201310, Uttar Pradesh, India.
2. Using the website
You may use the website to learn about Jai Zharotia and his work and to use the Foundation’s services. You agree not to:
- copy, download for reuse, collect or “scrape” its images or texts, or use them to train artificial intelligence or build datasets;
- try to get into parts of the website, accounts or files that are not meant for you, or interfere with its working or security;
- send false information, pretend to be someone else, or use the website for anything unlawful, including selling or promoting fakes.
3. Copyright
All artworks, images, poems, writings and texts on this website are protected by copyright and may not be reproduced in any form without the written consent of the Foundation and the holders of the estate of Jai Zharotia. Please read Copyright and permissions.
4. Accounts and membership
Membership is given at the Foundation’s discretion. Please give accurate information and keep your password to yourself; you are responsible for what is done with your account. The Foundation may decline, suspend or close an account, or withdraw access to private material, at any time, for example if these terms are not respected.
5. Information about works
We describe works as carefully and accurately as we can, from the Foundation’s records. Even so:
- colours on screen differ from the real work; sizes are approximate; titles, dates and other details may be revised as research continues;
- descriptions and images are for information only. They are not a guarantee of attribution, condition or value, and must not be relied on alone when buying or selling;
- a condition report and further details are available on request.
6. Not an offer to sell
Nothing on the website is an offer to sell a work. Showing a work, or stating that it is available, does not mean it can be bought. Prices are given on request. A sale is made only by a separate written agreement with the Foundation or the estate, on the terms set out in it.
7. Private viewings and online exhibitions
Private viewing rooms, previews and members’ material are shared in confidence with the people they are meant for, for a limited time. Please do not copy, record, forward or share their contents or links.
8. Authentication, registration and certificates
The authentication service has its own terms, shown on the Authentication page, which apply in addition to these. In summary:
- a certificate is the expert opinion of the Foundation at the date it is given. It is not a valuation, does not describe the condition of the work, and is not a document of title or proof of ownership;
- the Foundation may decline to examine a work or may not reach a conclusion, and its decision is final;
- fees are not refundable, whatever the outcome;
- a certificate is valid only as the original signed document and while the check page shows it as valid. The Foundation may revoke or replace a certificate, for example if new evidence comes to light or the work changes hands;
- registering a work records it in the Foundation’s catalogue raisonné. It is not authentication and does not give a certificate;
- the Foundation is not responsible for decisions to buy, sell, lend or insure a work, or for their results, whether or not they were based on its opinion, records or this website.
9. Links and other services
The website may link to, or use, services run by others (for example Instagram, sign-in with Google, Apple or Microsoft, and maps). We are not responsible for their content or for how they handle your information; their own terms apply.
10. Disclaimer and limits of responsibility
The website is provided “as is”. We try to keep it accurate, available and secure, but we do not promise that it will always be complete, up to date, uninterrupted or free of errors. To the extent the law allows, the Foundation and the estate are not liable for any indirect or consequential loss, or for loss of profit, opportunity or data, arising from the use of this website or reliance on its contents. Nothing in these terms limits any responsibility that cannot be limited by law.
11. Your information
How we handle personal information is explained in our Privacy policy.
12. Changes
We may change these terms from time to time. The date at the top shows when they last changed. Continuing to use the website means you accept the terms as they stand.
13. Law and courts
These terms are governed by the laws of India. Any dispute about them or about this website will be decided by the courts at Gautam Buddh Nagar (Greater Noida), Uttar Pradesh.
